Introduction

Cars 4 Executives Ltd (hereafter referred to as "we," "us," or "our") is a company based in London, offering premium transport services. These Terms and Conditions govern the use of our services. By using our services, you agree to comply with these Terms and Conditions.

1. Parties

This Agreement is made on the date of first contact with the Company for using the Company services through its booking procedure by the Passenger.

Between: Cars 4 Executives Limited, Company Registration No. 15113987 in England and Wales, actively trading as a Private Hire Operator licensed under the Private Hire Vehicles (London) Act 1998 and regulated by Transport for London (TfL) from its registered address 7 Wooldridge Close, Feltham, TW14 8BF (the "Company" – we / our / us).

And the customer(s), Passenger(s), the other party to this contract (the "Passenger").

2. Definitions

  • Booking Service: the service of booking a job or task of transportation of Passengers and luggage through the principal contractor by its own means of communication. A booking can only be accepted by a person that holds a relevant operator's licence.
  • Contract: this "Passenger Booking and Transportation Service Contract." The terms Contract and Agreement have the same meaning for this contract.
  • Passenger: includes customers, persons, or helpers assisting them or acting on their behalf. The words client(s), customer(s) and Passenger(s) have the same meaning.
  • Meeting Point: the Company's designated point of meeting for driver and Passenger at any London airport terminal, railway/underground/bus station, or sea port.
  • No Show: the driver has arrived at the designated time and pick-up point, but the Passenger failed to contact, appear or meet the driver within the waiting time.
  • PHV: private hire vehicle – a vehicle licensed by TfL.
  • Regulator: Transport for London (TfL) – the regulator of the Company's Private Hire operating business.
  • Transportation Provider: the principal contractor providing transportation following a booking.
  • Transportation Service: the Company's service of transporting pre-booked Passengers and luggage.
  • The Company: Cars 4 Executives Limited, registered in England and Wales, trading address 7 Wooldridge Close, Feltham, TW14 8BF.

3. Applicable Laws

The following laws and regulations may apply, including but not limited to: the Private Hire Vehicles (London) Act 1998; the Civic Government (Scotland) Act 1982; the Private Hires Act (Northern Ireland) 2008; the Local Government (Miscellaneous Provisions) Act 1976; Transport for London (TfL) Private Hire Vehicle (PHV) Regulations for Greater London; related local council or borough regulations pertaining to the operation of private hire vehicles outside London; applicable tax laws (e.g. VAT); and debit/credit card payment and bank transfer laws and regulations.

4. Jurisdiction

These terms shall be governed by and construed in accordance with English Law, and the parties submit to the exclusive jurisdiction of the United Kingdom.

5. Service Contract

The Passenger Booking and Transportation Service Contract is for the supply of booking and transportation services, subject to the Company's disclaimer, general and business terms and conditions, data and privacy policy notice, and complaints resolution procedure.

6. The Company

Cars 4 Executives Limited is party one in this contract. Under the Private Hire Vehicles (London) Act 1998, Cars 4 Executives Limited, as a licensed Private Hire operator regulated by TfL, has an obligation to Passengers to carry out bookings and is the first and principal contractor for the purposes of this contract. Acceptance of a booking creates a legally binding contract between the operator and the Passenger, under which the Company undertakes to provide a vehicle and driver to carry the Passenger to the agreed destination.

Equality, Diversity and Inclusivity: The Company is committed to providing services in accordance with the Equality Act 2010, and strictly follows a zero-tolerance policy for racism and discrimination on any basis provided by statute.

7. Passengers

Passengers may request booking and transportation services by phone, email, webchat or other applicable means, subject to the contractual terms and conditions and their statutory rights of cancellation and withdrawal. Agreeing to these terms grants the Passenger a limited, non-exclusive, non-transferable licence to access and use the Company's website, application or other platform to request bookings. The Company's services, content and related rights remain the Company's property. This contract is non-transferable and cannot be assigned to anyone else.

8. Contractual Relationship

  • Cars 4 Executives is responsible for both accepting the booking and the provision of the journey.
  • The contract is created between Cars 4 Executives and the Passenger for the booking and the provision of transportation services.
  • All fares for the journey are collected by Cars 4 Executives.
  • Only the operator (Cars 4 Executives) can cancel a booking with a Passenger.
  • Liability in relation to the transportation services belongs to Cars 4 Executives.

In the event of a complaint, dispute or conflict, the parties shall refer to the Company's complaints and resolution policy, subject to the laws of the UK.

9. Customers' Use of the Services

The Company's booking and transportation service is not available to persons under the age of 18. Passengers may not authorise third parties or persons under 18 to use their account unless accompanied by themselves, and may not transfer their account to any other person. Passengers agree to abide by all applicable laws and to use the services only for lawful purposes; the Company does not allow the transport of unlawful or hazardous materials. Passengers agree not to cause nuisance, annoyance or damage to Company employees, workers or drivers. The Company reserves the right to request proof of identity and may deny access or use of its services if this is refused.

By creating an account or giving explicit consent, Passengers agree the Company may send service or promotional messages; customers may opt out at any time. The Company may create and offer promotional codes and discounts at its sole discretion, subject to additional terms, and these may be withdrawn, disabled or invalidated at any time and cannot be exchanged for cash.

10. Contract Terms and Conditions

By accepting these terms, you also accept the Company's business terms and conditions and Data and Privacy Policy Notice, available at www.londonpointers.co.uk. The Company reserves the right to modify, correct or amend these terms, policies and notices, with notice of any changes announced on the Company website. Notice of information or cancellation may be given by email, phone, text message, webchat or post.

11. Booking and Transportation Services

The Company offers both booking and transportation services, in accordance with applicable UK legislation and subject to all statutory and regulatory obligations. This includes advertising bookings through the website, phone, webchat and/or email; accepting requests for booking (an "Offer") and accepting bookings (an "Acceptance"), including advanced or prescheduled bookings, without prejudice to the Company's right to decline or cancel a booking; entering into a legally binding contract for transportation through licensed drivers and vehicles regulated by TfL; keeping records of bookings; designating a suitable vehicle and driver; providing necessary identification details; charging a booking and transportation fee (fees are agreed prior to the journey and may be modified from time to time); monitoring bookings and transportation remotely; handling feedback, questions and complaints; and handling lost property in accordance with Company procedures.

12. Disclaimer

The Company provides its services on an "as is" and "as available" basis, subject to natural or unexpected events, weather, road works, or any temporary or permanent change to traffic plans issued by local or national authorities, and traffic jams or blockades.

13. Limitation of Liability

The Company is not liable for any booking that has not been accepted; for natural hazards, traffic delays, road closures or poor weather conditions; or for unconfirmed transfers without a booking confirmation and reference number. The customer acknowledges that these limitations are fair and reasonable.

14. Bookings

The Company offers booking of transportation of Passengers, or Passengers and luggage, from a pickup point to a drop-off destination, with or without additional stops. Bookings can be made by phone, email, the Company website, or any other applicable means of communication, including social media platforms such as Facebook, Twitter, Instagram and WhatsApp, for personal and non-commercial use unless otherwise agreed in writing.

Procedure: Bookings are taken with great care and detailed attention. The Company sends email confirmations to all Passengers. The booking Passenger is responsible for providing exact details of Passengers, luggage and any special needs. The Company is not liable for incorrect or misleading information provided by customers. All booking calls, web chats and emails are recorded and stored for training, monitoring and verification purposes.

Verification for Fraud Prevention: Bookings confirmed with credit/debit card details are subject to verification, and Passengers may be asked to provide ID with the card used for booking.

15. General

  • Cars 4 Executives Ltd reserves the right to amend these Terms and Conditions at any time for quality testing and development purposes. Changes will be posted on our website and anyone affected will be notified within 14 days. Continued use of our services implies acceptance of the revised terms.
  • We strictly prohibit loud music inside our vehicles for safety reasons, and to ensure drivers can focus on driving.
  • Alcohol consumption is not allowed without prior permission. Customers are responsible for any damage caused by spillages or other damage to vehicle surfaces.
  • Drugs are not permitted in our vehicles under any circumstances. Drivers may remove any passenger under the influence of drugs, with no refund and full responsibility for the trip borne by the customer.
  • All journeys must be pre-booked. The vehicle may have further bookings scheduled after your trip, so please schedule additional hours in advance to avoid inconvenience.

16. Contract of Service and Changes to Offers

  • All conditions of this contract apply to services arranged by Cars 4 Executives Ltd.
  • Additional fees may apply after the booking and start of service, such as extra hours, additional stops, extra mileage, waiting time, car parking, and address changes.
  • Hourly bookings must conclude in the same city as the start of the service; an additional charge may apply if it ends in a different city.
  • Customers can select from various vehicle classes and packages, and may upgrade based on availability with payment adjusted accordingly.
  • Bookings must be made with a minimum notice period: at least 4 hours within London, and at least 6 hours outside London (within the UK).
  • Child seats must be requested in advance, specifying the child's age and seat type needed.
  • Prior permission is required for passengers travelling with animals. Guide dogs will not be refused; other animals are accepted based on prior agreement.
  • Luggage and seating capacity are set out on our webpage. Additional luggage may incur extra charges if space allows, and additional passengers may be refused if safety would be compromised.

17. Delays

In cases of extreme weather, unavoidable traffic delays, GPS navigation errors or other unforeseen circumstances, Cars 4 Executives Ltd and its drivers are not responsible for any financial losses incurred by customers, including missed meetings, hotel bookings, flight delays or connecting flights.

18. Penalties and No-Show Policy

  • Any penalties, such as parking tickets resulting from customer actions without prior approval, will be charged to customers.
  • If a reserved vehicle becomes unavailable due to mechanical failure or other reasons, a substitute vehicle of a similar class will be provided.
  • A Passenger is considered a no-show for airport pickups if not contacted within 60 minutes, and for non-airport pickups if not contacted within 30 minutes.

19. Cancellations

Cancellations must be made at least 24 hours prior to the pickup time, and can be made via phone or email. For more information, please see our cancellation policy.

20. Changes to Booking

Changes to the destination can be made during the ride, and extra mileage costs will apply accordingly.

21. Behaviour in the Vehicle

Passengers must adhere to safety rules and laws: keep doors closed while the vehicle is moving, do not throw objects from the vehicle, do not put body parts out of the vehicle, do not shout from the vehicle, and smoking is prohibited within the vehicle. Any physical or verbal abuse, threats, harassment, or behaviour endangering the driver, vehicle or other passengers will not be tolerated. Passengers under the influence of alcohol or drugs may be refused travel.

22. Lost Property

Lost items will be returned to the operating centre and can be retrieved by contacting your driver or the office. Delivery costs for lost items will be paid by the customer. Please see our lost property policy for further details.

23. Complaints

24. Payments

  • Payments can be made via most major credit cards over the phone or via email payment link. Charges incurred due to different currencies or local accounts are the customer's responsibility.
  • Payment for extras added during the journey will be debited 24–48 hours after the trip.
  • Invoices are sent after journey completion; for journeys with added extras, the invoice will be sent within 24–48 hours after completion.
  • Customers may be required to show credit cards with ID if deemed necessary.
  • Extra charges apply for deviations from the original route or additional stops. Any extensions to a booking are subject to the driver's decision.
  • No cash payments are accepted.

25. Damages to Vehicles by Customers

Customers are responsible for valeting or repair charges for any soiling or damage to the vehicle's interior or exterior caused by them. Failure to pay for damages may result in legal action.

26. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.
